Class Action Employment Cases

Mr. Schaner has extensive experience litigating class action employment cases, including his defense of a class action lawsuit in which the plaintiffs sought $30 million in damages. The Dallas County jury concluded that the defendant owed nothing to the class plaintiffs. Moreover, Mr. Schaner has obtained a summary judgment for his clients in several class action employment discrimination cases. He is intimately familiar with the Federal Rule of Civil Procedure 23 class action requirements and the (opt-in) procedures under the Fair Labor Standards Act (FLSA). His experience includes cases under Title VII of the 1964 Civil Rights Act (Title VII), the FLSA, and the Worker Adjustment and Retraining Notification Act (WARN). Mr. Schaner is currently representing numerous plaintiffs/former employees under the WARN Act based on the employer’s failure to give the employees the proper 60-days advance notice of their layoff.
